Ferrell Discusses Pitfalls Of Badly Litigated Injury Cases in New Book

James “Jami” Ferrell, the founder of The Ferrell Law Firm, recently published a book titled “Seven Deadly Mistakes That Can Kill Your Memphis Accident Case.” A personal injury attorney, Ferrell provides first-time clients with his book, a CD about accidents in Memphis and other special reports.

Formerly an investment adviser, Ferrell made the transition into law soon after marrying. He attended the University of Mississippi School of Law and graduated in 2006. Ferrell first opened his firm in Olive Branch, and upon becoming licensed in Tennessee, moved his practice to Germantown in 2009.

Ferrell represents only seriously injured victims of car wrecks, animal attacks, workers’ compensation claims, medical malpractice, catastrophic injuries and wrongful death claims.

Ferrell is a member of the American Association for Justice, Tennessee Association for Justice, and the Memphis, DeSoto County, Tennessee and Mississippi bar associations. Ferrell practices with one associate, Christopher Johnson.

Q: What do you believe is different about The Ferrell Law Firm compared to other personal injury firms in the Memphis area?

A: My firm is different in many ways. I’m extremely selective in what type of cases I will handle. I have people call my office all the time and want to hire us for what I feel may be questionable injuries. I refuse to take these cases and tell them that they can call someone else and that they should be thankful to God that they are not more seriously injured. Secondly, I often tell people with minor injuries not to hire me and that they are sometimes capable of settling their case on their own. Sometimes, victims can end up with more money in their pocket when they settle on their own and don’t have to split the money with an attorney. But don’t get me wrong, anytime someone has more than a couple thousand dollars worth of damages, they are usually much better off in hiring an attorney to help them.

Q: Does The Ferrell Law Firm spend much money on advertising, or do you rely on obtaining clients through word of mouth or other means more?

A: I can say that I don’t spend anywhere close to what a lot of other lawyers here in Memphis spend on advertising. But in order to get our message out and to help as many people as possible, I do have a small advertising budget to work with. … Now we are at the point where word of mouth – about what we do and how we help people – has really begun to spread quickly here in the Memphis community.

Q: How does your book help new clients understand their personal injury case?

A: In the book, I give injury victims good, accurate information on how the claims process works and how to navigate among the real sharks out there – insurance adjusters. This book isn’t (just) for new clients. It’s for everyone, especially those who don’t have a lawyer and don’t know how miserable this whole process can be. I walk them through the entire claims process and show them the pitfalls to avoid, as well as give them information on how to find and choose a lawyer for their case if they feel they need to hire one.

Q: You practice with just one associate. Do you have plans to expand your firm in the future?

A: We will probably expand with another lawyer at some point in the not-too-distant future. But we also have a great relationship with another firm here in Memphis that we often work with on cases. This allows us the benefit of having additional attorneys to help us with some of our clients. I’ve found the key is to surround yourself with great people, and that’s what we do.

Q: On your Web site, you say that several other personal injury lawyers have never been in court, instead settling their cases out of court. Is this common?

A: It’s not necessarily a bad thing to settle cases out of court. In fact, the vast majority of cases are settled before going to trial. However, in order to keep insurance companies honest and to make sure you are getting the most for your client, you must be able and willing to go to trial if you can’t get a fair settlement for your client. … Insurance companies are smart. They keep a record of every attorney and law firm that they have worked with. And they know which ones are willing to go to trial and which ones simply want to settle as quickly as possible. If you are interviewing potential attorneys for your case, make sure that you find one that is willing to take your case all the way.

Why do I have this blog?

I was reading a fantastic post written by Ronald Miller today concerning his thoughts on why lawyers have blogs. Mr. Miller’s post started me thinking about my own reasons for this site and this blog.

Why do I have this site and this blog? And what are my motivations?

The primary reason for this site is to educate and inform people. I wasn’t always a lawyer. Before becoming a Memphis lawyer working with victims of car wrecks and truck accidents I was an ordinary person no more familiar with the law than most of you. If I would have been involved in a car wreck or been injured somehow I would not have known where to go, what to do, who to talk to and who not to talk to. Because of my background, I understand that it can be really confusing when you feel like you don’t know anything.

That’s why I decided to give away as much information away as possible. I want people to feel informed, knowledgeable and comfortable with what is going on around them if they have been in an accident. Other lawyers here in Memphis and Mississippi try to sell, sell, sell. They want you to sign on the bottom line and hire them. I want to teach, teach, teach. And I after I teach you I want you to be able to come to your own conclusions concerning: what you should do if you’ve been in a car wreck or injured in any way, how to determine if you should even hire a lawyer, and if you do need to hire a lawyer I want to help you learn how to choose the right one.

That’s what this blog is about. It’s all about being a teacher and helping others.

In my life I’ve always been very fortunate. I’ve always practiced the theory that those that give unconditionally, without demanding something in return will be rewarded. For me this has always held true. I give my love to others and I have received multiples of that love in return. I donate my time and money to others and have received much happiness and satisfaction from doing so. And in my practice I have been lucky that people who I help, often turn to us for help.

I’ll continue to post relevant and useful information for victims of accidents here in Memphis, Tennessee and throughout Mississippi. And I hope this info will help you with your case or settlement.

What I will NOT do on this site is fill it full of useless information just to bring in more visitors. A lot of other lawyers do this. They hire companies to scour the internet and newspapers looking for accident reports that the hired guns then copy and paste right into the lawyers blog. These lawyers do this just hoping that the person will do a Google search for their name and accident information. No useful information is provided, they are simply trying to suck you into their site. I promise we will never do that. If you do see a news report on our site it’s because we found it relevant to what’s happening in the community and it provides useful information for you. Examples of this are when very large injury verdicts are awarded or a special event occurs.

Please don’t think that just because of what I’ve written above that we don’t want your business. We do. If you fit our specific client criteria we would be happy to help you. But we want you to be informed and knowledgeable first and foremost. And to do that we try to provide honest and authentic material to guide you.

Who is the best personal injury and accident lawyer in Memphis?

It’s impossible to say who is the best personal injury and accident lawyer in Memphis. No one can answer this question. Every case is different and one attorney may be perfect for one person and their case, but not quite the right fit for another.

Some of the things to look for when you’re trying to find an accident or injury lawyer for your case is as follows:

  • Do they specialize in personal injury and accident law?
  • What is their area of expertise in injury and accident law?
  • Does the lawyer understand the medicine and injuries involved in your case?
  • Are you comfortable with the lawyer?
  • These are just a few of the things you should look at and ask when you’re searching for the best attorney for your case.

    Who hasn’t sued Disney?

    I might be a Memphis, Tennessee personal injury and accident lawyer but any of my friends or family can tell you that I’m also a huge Walt Disney World (WDW) fan. I love going to WDW, I love thinking about going to WDW and I even worked for WDW at one point in my life. But have you ever stopped to think about how many lawsuits are filed for personal injury and accident claims against WDW and the major theme parks down in Orlando? There must be tons of them right?

    To be exact, according to the Orlando Sentinal, there were 447 personal injury and accident lawsuits filed against the major Orlando themeparks between January 1, 2004 and December 31, 2008. That’s 89 lawsuits a year, or 1.7 lawsuits filed per week. That doesn’t count any slip and fall, accident or injury claims that were settled without filing suit.

    Many of these claims were for legitimate issues, such as when a taxi ran over a toddler. Yet many others were for comical claims, such as when a man sued for “embarrassment” when a ride attendent “challenged” him as he was entering a Fastpass line inappropriately.

    Just remember, if you’ve been in a legitimate accident here in Memphis where there were you were seriously hurt I’m here to help you. But DON’T call me or my law office if you did something wrong and were then “called out” and became embarrassed! Shame on you, you should be embarrassed. And you should be even more embarrassed if you’re attempting to sue someone because of it.

    Don’t become the next bike accident victim

    When most of you saw the headline above you probably thought I was talking about motorcycle wrecks and accidents. And although my law firm does take on cases where riders of motorcycles have been hit and hurt, what I’m writing about today is good old fashioned peddle power.

    I love Memphis, but it’s not a great community for bike riding. My office is only 1.5 miles from my home and I’d love to be able to ride to work. However, to do so is difficult and dangerous. That’s because the city streets are built without regard to bike riders. This is something that the city, suburbs and county need to do something about. The new purchase of the railroad right-of-way from Midtown to Shelby Farms is a step in the right direction, but an aggressive stance needs to be taken by someone to make the more of the city and county safe for bikers.

    In the meantime, remember: accident cases aren’t always car vs. car. They often end up much worse when they are car vs. bike or car vs. pedestrian – make sure to give bikers a at least a three-feet wide berth, and we will all stay happy and healthy!
