Why We Are Different

We’ve thrown out the old style lawyer method of billing by the hour. Instead, all of our plans are on a flat fee basis. What that means for you is that you no longer have to worry about getting a bill each and every time you call your lawyer asking a simple question or for clarification.

The “traditional” experience with a lawyer probably goes something like this:

You go in and meet with a lawyer who will probably make things seem very complicated and confusing. The attorney sounds smart and seems to know what he or she is talking about so you nod and answer his or her questions, as if you understand everything. Since you want to do the right thing for your family, you’ll have the lawyer prepare all the documents for you, which you’ll then sign. You go home that night with the feeling of relief that you’ve got everything taken care of.

Next, you take your fancy estate planning binder home, stick it on a shelf or in a closet, and never think about it again.

You probably slightly remember your attorney saying something about moving your bank accounts and assets into the trust. So you’ll go to the bank, forget exactly what you were supposed to do, call your lawyer’s office, get a voicemail, have to leave the bank and wait for a call back, (which takes several hours at least and sometimes days) and by then you’ll probably have gotten busy with other things and never get around to moving those assets.

Several weeks later, you’ll get a bill in the mail for $75 for 15 minutes of your estate planning lawyer’s time for answering a couple of questions. You then think to yourself- “don’t call lawyer ever again”.

Several years after making your plan, you’ll refinance your house or sell and buy a new one, forgetting that you were supposed to let your attorney know or make sure you kept the title to the home in the name of the trust.

Your children will get older and your guardianship choices will become outdated, but you don’t want to call your lawyer because you know you’ll get a bill in the mail three weeks later.

You’ll hear something about some new change in the tax law, but you figure you would have received a letter in the mail from your lawyer if it were something that affected you, so you don’t worry about it. Anyway, you’d have to dig through files and boxes to find your trust documents so you could remember what your lawyer’s name was and find his contact information; you don’t have time for that.

It’s not until you die or become incapacitated and your family finds the trust documents that you stuck in a box years before and never looked at again, that they realize your plan is outdated and has nothing to do with your life, your assets and the law.

Your family is devastated. They don’t know where to go or what to do, so they contact the same attorney you used to prepare the trust, who is as happy as can be to probate your estate, which never made it into the trust.

How do I know all this? Because I’ve seen it, happening again and again with families that weren’t prepared and weren’t guided properly.
